Summary

The Assistant General Counsel is responsible for: ensuring that the General Counsel's Office and the President, CEO are properly informed of major legislative matters of importance to DSI; further elevating DSI's influence/position with PhRMA, HINJ and similar associations (and their member companies) through ongoing, active interaction and direct advocacy with its top leadership and key section heads; and, supporting company staff who serve as officers/Board of such associations. Day to day responsibility for legal issues including, for example, Government Pricing, Contracting and other areas as assigned as well as managing outside legal services engaged for such issues. Monitoring current legislative developments germane to the pharmaceutical industry (generally) and oncology (in particular) and assigned legal areas to ensure education of relevant company personnel on such issues.

Responsibilities:

  • Key legal advisor to DSI's Government Pricing and Contracts teams; maintains strong awareness of the operations of these functions to ensure successful relationships with such departments. Ensures consistent and timely legal review and analysis across such functions and advises senior management about key issues regarding same. Proposes and manages various legal projects to support the mission of DSI. Reports to and consults with manager regarding significant, mission critical, and strategic issues. Under the supervision of manager, develops overall legal risk management strategies for DSI in assigned client areas.
  • Representation of DSI as a Leader in Industry Associations: Day to Day responsible for coordination of relationship with external government affairs trade associations (such as PhRMA, HINJ and other similar associations), and preparation of Sr. Management in their Board roles. The position requires the incumbent to represent DSI on relevant regional legislative and other trade association task forces and/or committees that are organized under the auspices of these associations where DSI maintains a membership. Where such task forces or coalitions exist, the incumbent is responsible for maintaining an active role within the groups in order to move policy decisions in concert with DSI's overall priority objectives and coordinate the committee assignments by other DSI staff (primarily within LCA). The Assistant General Counsel must be able to educate management across DSI on new initiatives, prioritize such issues and proactively align with all levels of DSI Management (as required) on such issues to develop the DSI voice on such issues. The Assistant General Counsel must also maintain the visibility of DSI through his/her lead participation and contributions in such contexts, protect the interests of DSI, and be able to assertively voice, advance and represent views beneficial to DSI, even though they may run contrary to those initially advanced by other pharmaceutical companies, such associations or interest groups. In this role, the incumbent must support the various officer/board members of Sr. Management on such issues as well in preparation for their roles.
  • Industry-Wide Issues Management: The Assistant General Counsel will serve as a political strategist for DSI on the state (as assigned) and federal levels, and will be required to continually and independently (a) monitor and analyze proposed laws, regulations and policies potentially affecting the pharmaceutical industry overall as well as DSI specifically; (b) survey, weigh and evaluate the unique, nuanced political and governmental landscapes of multiple states on an individualized basis; and (c) conceptualize, develop, recommend, and proactively implement multifaceted strategic courses of action for the business working with applicable associations/any professional staff
  • Retention, Oversight and Deployment of Outside Lobbyists: To the extent engaged by DSI, the Assistant General Counsel Director will be responsible for determining the need to use outside services in the form of contract lobbyists and manage such outside services. The Assistant General Counsel is responsible for managing this "virtual government affairs staff" in the region relating to and such services but also advise management on those regions and issues where such outside support is warranted.

Education Qualifications (from an accredited college or university):

  • Bachelor's Degree from 4-year College or University of recognized standing preferred (degree in Life Sciences, Government, Political Science, Public Administration, Public Policy or other area germane to functions of the position preferred but not required) required
  • JD from Law School of recognized standing, and Bar Admission in NJ (direct admission or eligible for limited in-house licensing in NJ) required

Experience Qualifications:

  • 4 or More Years Post-law school experience, including broad pharmaceutical industry experience, in multiple disciplines (e.g., Food Drug & Cosmetic Act, Anti-Kickback, Antitrust, Pricing, Government Contracts and Rebates) (five or more years preferred) required
  • 7 or More Years Lobbying experience or similar government affairs role. Demonstrated knowledge of key public policy issues germane to the pharmaceutical industry, including substantive familiarity with matters concerning healthcare policy; government healthcare programs including Medicaid and Medicare; drug formularies; pricing; and related issues. Understanding of the political environment confronting the pharmaceutical sector. required

Travel:

Ability to travel up to 40% This position may be based in either New Jersey or Washington, DC. If in NJ, this position may commonly require approximately 30-40% of the time to be spent for domestic travel. The incumbent may also be required to attend association and other meetings and political events occurring after normal business hours and occasionally on the weekends.
