Description

Northwest Kidney seeks Counsel/Compliance Officer to manage and work collaboratively with cross-functional teams to address a broad array of legal issues. This position reports directly to the President/CEO and works out of the Burien Pavilion. .

General Summary

The Counsel manages all legal services for Northwest Kidney Centers to ensure the organization has procedures in place to protect the interests of the organization and ensure full legal compliance of operations. This role will provide legal advice and counsel on a number of complex issues and will lead legal efforts to include the effective use of outside legal expertise when necessary. In addition, the Counsel will serve as the Compliance Officer for NKC and will have a dual reporting relationship to the CEO and the Board in this capacity.

ESSENTIAL FUNCTIONS

  • Provides legal advice and counsel to Executive Team members and leadership on all legal matters relevant to NKC. This includes employment law, policies, procedures, real estate transactions, contracts, liability and insurance matters, EEOC and other laws and regulations.
  • Anticipates and identifies legal issues and counsels the Executive Team and Leadership in order to develop legal strategies and solutions.
  • Reviews, researches, interprets, and prepares written and oral opinions on a wide variety of legal issues.
  • Drafts, reviews, and approves policies and procedures, regulations, bylaws and other legal documents.
  • Reviews contracts, leases, and other legal documents; researches legal issues and recommends revisions as necessary.
  • Represents or oversees the representation of NKC in judicial and administrative proceedings.
  • Selects and retains outside counsel, as necessary, to obtain legal opinions or to handle claims and litigation.
  • Provides training to NKC on various legal issues through meetings and other means.

COMPLIANCE FUNCTIONS
  • Oversees and manages the corporate compliance program which includes developing and implementing an annual compliance program.
  • Acts as the compliance subject matter expert, particularly with respect to HIPAA privacy; maintains a current working knowledge of Federal and State regulations that impact NKC.
  • Designs and oversees HIPAA training and compliance monitoring with other appropriate areas of the organization.
  • Develops, initiates, maintains, and revises the Code of Conduct.
  • Leads the Management Compliance Committee and presents compliance reports directly to the Board Compliance Committee.
  • Reviews and evaluates compliance issues/concerns with the organization; conducts investigations of suspected non-compliance issues.
  • Conducts internal compliance audits/reviews in collaboration with key leaders.
  • Completes annual compliance risk assessment: identifies potential areas of compliance vulnerability and risk, develops and implements corrective action plans for resolution of problematic issues.
  • Provides input into mandatory education and training requirements for employees. Maintains compliance-related records and ensures record retention processes are in place with subject matter experts.
  • Reports violations or potential violations to duly authorized agencies as appropriate/required.
  • Develops, coordinates, and conducts compliance training and promotion with other functional areas for existing and new employees.
  • Responds to government investigations and queries as the principal point of contact.
Qualifications
  • J.D. from an American Bar Association accredited law school and member of the Washington State Bar.
  • Minimum 5 years of experience directly related to the essential functions specified.
