Assistant Prosecuting Attorney

Description

Job Purpose or Objective(s): Responsible for prosecuting criminal, juvenile, quasi-civil, wildlife, traffic and deprived actions on behalf of the Choctaw Nation as assigned by the Lead Tribal Prosecutor.

Primary Tasks:

-Represent the Choctaw Nation in criminal matters within the reservation/jurisdiction of the Choctaw Nation as assigned by the Tribal Prosecutor.
-Represent the Choctaw Nation in juvenile cases and deprived actions within the jurisdiction of the Choctaw Nation of Oklahoma as assigned by the Tribal Prosecutor.
-Review police reports and affidavits to determine appropriate charge in criminal matters assigned by the Tribal Prosecutor.
-Advise Tribal Police and ICW regarding investigations, case preparation, and legal issues.
-Appear on criminal and juvenile dockets as assigned by the Tribal Prosecutor.
-Maintain good inter-departmental relations and communication with the judicial department, Children and Family Services, state offices, all law enforcement departments and other legal departments.
-Assist in drafting legislation affecting children, juvenile, and criminal laws, to be considered by the Tribal Council, as directed.
-Confer with the Lead Prosecutor and Executive Director of Children and Family Services making referrals for the transfer of cases that may be prosecuted in the Choctaw Nation District Court.
-Prepare legal notices and pleadings in juvenile, deprived, and criminal actions as may be needed.
-Prepare and litigated civil forfeiture actions.
-Provide training as needed to Tribal Police and ICW.
-Perform other duties as may be assigned.
